EUPHORICATZ COMMISSIONS TERMS OF SERVICE (ToS)

By commissioning any digital services provided by Euphoricatz (the "Artist"), you (the "Client") automatically acknowledge, understand, and agree to all the terms and conditions outlined in this document. Please read them carefully before proceeding.

1. General Terms & Rights Policy● Right of Refusal: I reserve the right to decline any commission request at my discretion, particularly if it violates my personal, ethical, or professional boundaries.

● Artist's Rights: As the original creator, I retain full copyright and ownership of the commissioned digital asset. I reserve the right to display the artwork in my portfolio, promotional materials, and social media unless explicitly agreed otherwise.

● Client's Rights (Personal Use): The Client is granted full rights for personal, non-commercial use only. The Client may crop, resize, or use the artwork as profile pictures or banners. Editing or altering the artwork itself is permitted strictly for personal use.

● Commercial Use: Reselling the commissioned work, minting it as an NFT, or using it for merchandising/monetization is strictly prohibited without a prior written agreement and the payment of applicable commercial licensing fees.

● Privacy/NDA Agreements: For private commissions or "Special Projects," I reserve the right to share the commissioned work publicly unless a non-disclosure agreement (NDA) or privacy fee is discussed and agreed upon prior to payment.

2. Work Schedule & Operational Context● Working Hours: My standard working schedule is Monday to Friday, from 5:00 PM to 10:00 PM (UTC-4). Weekend work is strictly at my discretion.

● Regional Infrastructure & Delays: I am located in a region where unexpected power outages and internet disruptions are frequent. While I maintain a strong professional work ethic and do not use personal circumstances to neglect my duties, these infrastructure limitations may occasionally delay progress by a few hours or days. I will always maintain active communication if an ongoing commission is affected.

● Waitlist & Workflow: Pre-ordering secures your slot in the queue. However, I may occasionally start sketches ahead of schedule to keep the workflow dynamic and keep you engaged.

3. Payment Process & Invoicing● Currency: All prices and payments are strictly in United States Dollars ($USD) via PayPal Invoices.

● Prepayment: All commissions must be paid in full (100% upfront) before any work begins. This secures your slot and compensates for the initial labor.

● Zero-Notes Policy (Crucial): When paying the PayPal Invoice, the Client must NOT add any notes, addresses, or comments. Any invoice paid with notes will be immediately refunded, and the commission will be canceled.

● Digital Goods Acknowledgement: By paying the invoice, the Client acknowledges they are purchasing a non-tangible, digital service. No physical items will be shipped.

4. Refund & Cancellation Policy● Not Started: 100% refund (minus PayPal transaction fees) if I have not yet begun the sketch.

● Sketch Stage: 50% refund if the commission is canceled during or immediately after the sketch phase. This covers the time and conceptualization invested.

● Post-Lineart/Coloring Stage: NO REFUNDS will be issued once the lineart or coloring phase has begun, as the service is nearing completion and the allocated time has been consumed.

● Chargebacks: Initiating a PayPal chargeback without prior communication violates these terms. Doing so will result in the immediate cancellation of the project, revocation of all usage rights to the artwork, and blacklisting from future services.

5. Commission Process & Revisions● References: Clear visual references (digital or physical) or highly detailed textual descriptions must be provided upfront.

● Communication: I prefer to handle all commission details via direct messages on my officially listed social media or messaging platforms.

● Revisions (Sketch Phase): I encourage client feedback. Structural revisions and major changes are welcome and free of charge only during the sketch phase.

● Revisions (Post-Lineart): Once the lineart is approved, only minor adjustments or corrections due to my own human error are free. Any complex changes, additions, or re-designs requested after the sketch phase will incur an extra fee.

● Delivery: Upon completion, the final high-resolution digital asset will be delivered via email or secure cloud link to preserve quality. A one-week grace period is provided post-delivery for minor, non-structural corrections.

6. Content Guidelines (What I Draw)● Accepted Subjects: Furry/anthro, anime, original characters (OCs), fan art, humans, basic weaponry, simple machinery, and macro/micro themes (within manageable scope).

● Suggestive Content: I accept tasteful, non-explicit suggestive themes or eroticism, provided they remain within respectful boundaries.

● Complex Backgrounds/Details: Extremely detailed backgrounds, armor, or intricate machinery may require an extended timeline and an additional fee based on the complexity.

7. Content Exclusions● Not Safe For Work (NSFW): For public and standard commissions, I do not accept explicit NSFW content, as it does not align with my standard business operations and payment processor guidelines. (Note: For special projects, long-term collaborations, or specific conceptual themes not listed here, please contact me directly via DM to discuss feasibility).

● Hateful/Problematic Content: I strictly refuse any artwork involving non-consensual themes, underage explicit content, radical political propaganda, or any content that violates my personal ethical boundaries. I reserve the ultimate right to determine what falls into this category.
